Interesting for sure but with where they sit I think there is too much on the line for them to shut it down ….I think they would have to become aware of additional circumstances/evidence that is likely to clearly implicate miller.

I don’t know if there is conflicting info or not. It would depend on if/how Miller replied to Miles' text messages. His lawyer is making it sound like Miller didn't reply or even see the message Miles sent asking for the gun.
Again, not saying I buy it, just sharing what the lawyer is selling.

The fact that Bama and the DA decided to it didn't even require an investigation is pretty telling, IMO.
Speculation here …every case is SUPPOSED to be handled the same regardless of who the victim is and regardless of who the alleged offender is…. that being said, it doesn’t always shake out that way. I’ve done no research into the prosecutors current election cycle , prosecutorial history, or political affiliation but just evaluating generally my guess is he or she is going to be slow to file any formal charge against miller even if initial information supports it. The following are substantial factors 1. It’s going to be a high profile case so you either show off for the cameras or you’re careful not to make a mistake to look stupid when the magnifying glass is on you 2. It’s unfortunate that our current climate is what it is but millers race has to factor into the timing decision because you don’t want the aclu or Ben crump ripping you for filing a formal charge without sufficient position to do so. Well founded filings are scrutinized …Reactionary filings are crucified so if you decide to charge him make sure you’re right first 3. A slight delay could let miller finish his season so even if you choose to charge him you haven’t alienated a fan base that may make up a large portion or your electorate and you also may win favor with the university which could carry political influence

Wouldn't saying, "hey I'm in an argument, bring me my loaded gun" generally put the person bringing the gun into a position of knowledge about what might happen?
I had not seen that. You are definitely correct If I was prosecuting the case that would be a central component to determining if he should be charged. Any other information that comes to light that suggests prior knowledge increased the likelihood he may face some criminal liability.

It’s definitely a pickle …I read an article that mentioned some facts that allegedly came from arrest affidavits…without being intimately familiar with Alabama laws ( as they may differ slightly, in a general sense, from Indiana criminal code), the most interesting point of the fact pattern for me was a mention of millet having parked his vehicle in such a way that appeared to impede the movement of the victims vehicle. The potential for criminal liability ( or defense therefrom) hinges primarily on miller having knowledge of his friends intent to commit a crime or if he should have been reasonably aware. He could hold a position of plausible deniability if he had no knowledge of a potential conflict and simply brought the firearm at his friends request. If he had further detail of the purpose for the request ( which purposefully boxing in a car could suggest via circumstantial evidence) he could open himself to co-conspirator ,felony actor, accomplice , or vicarious liability -

No that’s the sad part …if you have the athletic ability they will get you in regardless of red flags or liability and they don’t care about much more than the w’s or the l’s and in the world of nil you can’t be too hard on the kids or they leave

Makes them very fun to watch …Blackmon was shooting really poorly to start the season but has picked it up big time in the last 5 games and josh smith is a double double machine …you might see them in the NCAA tourney this year or next …they almost got Pete suder from Carmel too who ended up at bellarmine ……I went through all the qualified shooters who are 40% from three and only two players in the country are shooting 50/40/90, luke brown is the only one shooting 50/50/90

True even the people who really didn’t like him were fair about that I think the main knock was he could shoot against small high schools but he wouldn’t be able to against D1 defense and the ASUN isn’t a power conference but they’ve played Florida state Florida ucf and south Florida on top of their conference so I also wouldn’t say it’s been a cake walk

Stetson game tonight brown 20 on 7-10 from field and 6-7 from three. Blackmon 21 on 7-11 shooting. Josh smith with 16 and 9 boards. Indiana kids put up 57 points and brown and blackmon have combined for 96 the last two games
suder was solid for bellarmine also with 14 but Stetson blew them out from the tip

First in person game today in several years …anyone else going ? Northwestern has been playing solid …looking forward to an iu win and seeing a healthy barnhizer for northwestern

From watching all of them in high school multiple times I would have had Furst ( other than Morton ) as their best recruit I would have had kaufman renn around a hundred or higher …I understand smiths size hurt him in the rankings but intangibles matter and if you have a kid who is a winner and has to work to get there they can be worth a chance and it’s gonna pay off for them for four years which is frustrating I think you are exactly correct and the majority of the top 100 ( whether true or not ) are convinced that they are going somewhere for a year or two and on to the pros ….a lot of kids could make more money stringing together 3-4 years of deep tourney runs and or national championships as you said but we will probably never find out

SO true …they aren’t staying long enough to coach and the coach needs them more than the player needs the coach …not a recipe for team building so you live or die by the talent

It’s because he goes and finds the kids they will be ( for the most part ) 3-4 year players and he takes the time to not JUST look at the ranking boxes that have been checked and settle there …he takes kids who will have a chip on their shoulder and he values hard work as much as talent. A kid they is told they are gods gift from age 10 through high school often starts to believe it and they’ve always been good. A kid like Braden smith is athletic enough but he’s where he is because he’s spent his life out working and wanting it more than his opponents ….you need a team full of that to be successful if you aren’t getting top 100 kids and painter does that

Morally ? Probably ….optically ? Probably ….I think the problem is the prevailing fear that if you take an administrative action and NOTHING ever comes to light that would implicate miller criminally or, worse , if something clearly exculpatory is brought into the public domain now you’re going to deal with not only the wrath of the school and fanbase but also the direct brunt of our fair weather/ bandwagon media who will jump on whatever the trend du jour is. headline: NCAA unfairly ruins alabamas best historical season and drastically damages top prospects draft status ( probably written more dramatically )
